RELEASE, WAIVER AND INDEMNITY - CHRISTIAN YOUTH BASKETBALL ASSOCIATION PLEASE READ CAREFULLY - THIS IS A LEGAL DOCUMENT THAT CONTAINS A GENERAL RELEASE I,

, FOR MYSELF AND THE PERSONS LISTED BELOW (COLLECTIVELY, THE “PARTICIPANTS”), HEREBY EXEMPT, RELEASE AND RELIEVE THE CHRISTIAN YOUTH BASKETBALL ASSOCIATION (“CYBA”), SOUTHWEST CHICAGO CHRISTIAN SCHOOL (“SCCS”) AND THEIR RESPECTIVE EMPLOYEES, DIRECTORS, VOLUNTEERS, OFFICERS, MEMBERS AND AGENTS (collectively, “Representatives”), FROM ALL CLAIMS AND LIABILITY FOR ANY PERSONAL INJURY, PROPERTY DAMAGE, WRONGFUL DEATH OR OTHER INJURY OR DAMAGE TO THE PERSON OR PROPERTY OF THE PARTICIPANTS ARISING OUT OF OR INCURRED IN CONNECTION WITH PARTICIPATION IN OR INCIDENTAL TO ANY CYBA ACTIVITIES, INCLUDING BUT NOT LIMITED TO THE RELEASE OF ANY CLAIMS AND DAMAGES CAUSED BY ANY NEGLIGENCE OF CYBA, SCCS OR THEIR RESPECTIVE REPRESENTATIVES. THIS RELEASE, WAIVER AND INDEMNITY IS GIVEN BY THE UNDERSIGNED FOR:

AND FOR ALL OTHERS, INCLUDING ALL OTHER MINORS, THAT ACCOMPANY ME OR A PARTICIPANT TO ANY CYBA ACTIVITIES OR THAT ATTEND ANY CYBA ACTIVITIES, EVEN IF SUCH ADDITIONAL PERSONS ARE NOT DIRECTLY PARTICIPATING (“COLLECTIVELY, THE ATTENDEES”). ACTIVITIES SUCH AS PLAYING OR WATCHING basketball, AS conducted BY CYBA, INVOLVE athletic ACTIVITIES WHICH INVOLVE DANGER AND RISK OF INJURY TO PARTICIPANTS AND SPECTATORS, AND ON BEHALF OF HIMSELF/HERSELF AND THE ATTENDEES, THE UNDERSIGNED expressly and specifically assumes the risk of ALL damage, injury AND/OR harm in connection with such activities. For and in consideration of the Attendees being allowed to participate in or attend CYBA activities, the undersigned does hereby voluntarily and absolutely release, discharge, waive and relinquish any claim, loss, damage or action for personal injury, property damage, wrongful death or otherwise of the undersigned and the Attendees arising in connection with all CYBA activities or anything incidental thereto, wherever, whenever or however occurring. The undersigned also releases, discharges, defends and holds harmless CYBA and its respective Representatives from any claim, demand or action relating to any first aid/medical treatment rendered in connection with any injury related to participation in the activities. By signing this document, the undersigned affirms that he or she expressly and knowingly allows the Participants and Attendees to attend and/or participate in the CYBA activities. The undersigned also acknowledges that CYBA is renting the gymnasium of SCCS for the activities, and CYBA is not affiliated or partnered with SCCS, and the activities of CYBA are not a program of SCCS. The undersigned, for the Participants, Attendees and himself/herself and their respective heirs, executors, administrators or assigns agrees that in the event any claim for personal injury, property damage, wrongful death or other damage or liability is brought against CYBA, SCCS or any of their respective Representatives related to the participation in or attendance at CYBA activities, or anything incidental thereto, the undersigned will indemnify and hold harmless CYBA, SCCS and their respective Representatives from and against any and all such claims brought by or on behalf of the undersigned, any Participants, Attendees or by any other person or entity related to the undersigned or a Participant or Attendee, wherever made or presented. Under no circumstances will the undersigned or any Participant or Attendee present any claim against CYBA, SCCS or their respective Representatives for personal injury, property damage, wrongful death or otherwise, including but not limited to as caused by any negligence of CYBA, SCCS and/or their Representatives. The undersigned parent or guardian represents that he/she (i) has thoroughly read and understands this Agreement and has requested and been provided with, or has determined not to request, advisement on this Agreement and/or the potential dangers/risks of engaging in or attending any CYBA activities, and (ii) assumes all risks associated with such dangers and risks for himself/herself and on behalf of the Participants and Attendees, and (iii) fully understands the terms and the legal consequences of signing this agreement and providing the release herein. The undersigned intends his/her signature to be a complete and unconditional release of all liability to the greatest extent allowed by applicable law, and if any portion of this Agreement is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.
